Terms of Service
These terms are the agreement between you and Neon Path Labs LLC for the use of Payday Flo. Please read them — by using the app, you agree to them.
Payday Flo is a budgeting tool, not financial advice. It organizes numbers you enter and shows you projections based on them. It is not a bank, is not a financial advisor, and does not move money. Decisions about your money are yours — please consult a qualified professional for advice specific to your situation.
1. Agreement to these terms
These Terms of Service (the "Terms") form a binding agreement between you and Neon Path Labs LLC ("Neon Path Labs," "we," "us," or "our"), an Ohio limited liability company, governing your use of the Payday Flo mobile application and any related services (the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
2. Who may use the App
You must be at least 13 years old to use the App, and at least 18 (or the age of majority where you live) to purchase a subscription. By using the App you represent that you meet these requirements and that you are not barred from doing so under applicable law.
3. What the App does — and does not do
Payday Flo helps you plan around your paychecks: you enter your income, bills, balances, goals, and debts, and the App organizes that information and produces plans, forecasts, and reminders.
The App does not provide financial, investment, tax, legal, or accounting advice. It does not hold funds, execute payments, or transfer money on your behalf. Marking a bill as paid inside the App is a record-keeping action only — it does not pay anyone. You remain solely responsible for making your actual payments on time.
Projections, forecasts, payoff timelines, and reminders are estimates generated from the information you provide. Their accuracy depends entirely on the accuracy and completeness of what you enter. We do not guarantee any particular financial outcome.
4. Your account
You may use the App without an account, or sign in with Apple. If you create an account, you are responsible for activity that occurs under it and for maintaining the security of the device and Apple ID used to access it. Notify us at help@neonpathlabs.com if you believe your account has been compromised.
5. Your data and backups
Your budget information is stored on your device and, if you enable it, synced through your own iCloud account. You are responsible for maintaining your own backups. We do not keep a copy of your budget data and therefore cannot restore it if it is lost, if you delete the App, or if a device fails. Our handling of information is described in our Privacy Policy, which is incorporated into these Terms.
6. Subscriptions and billing
6.1 Plans
Certain features require a paid subscription (currently offered as Payday Flo Core and Payday Flo Plus, on monthly or annual billing). Current pricing is shown in the App before you purchase.
6.2 Payment and auto-renewal
Subscriptions are sold through the Apple App Store. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
6.3 Free trials
If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Unless cancelled at least 24 hours before the trial ends, the trial converts automatically to a paid subscription.
6.4 Managing and cancelling
You can manage or cancel your subscription in your Apple ID account settings (Settings → your name → Subscriptions). Cancelling stops future renewals; you keep access through the end of the period already paid for.
6.5 Refunds
Purchases are handled by Apple, and refunds are governed by Apple's policies. Request one at reportaproblem.apple.com. Except where required by law, fees are non-refundable by us.
6.6 Price changes
We may change subscription pricing. Changes apply to future billing periods, and where required we will give you advance notice and the opportunity to cancel before the change takes effect.
7. Licence
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, in accordance with the App Store Terms of Service and for your own personal, non-commercial use.
8. Things you agree not to do
- Copy, modify, translate, or create derivative works of the App.
- Reverse engineer, decompile, or disassemble the App, except where that restriction is prohibited by law.
- Rent, lease, lend, sell, sublicense, or redistribute the App.
- Circumvent, disable, or interfere with security, subscription, or entitlement features — including obtaining paid features without paying for them.
- Use the App for any unlawful purpose or in violation of these Terms.
9. Third-party services
The App relies on services we do not control, including Apple (distribution, Sign in with Apple, in-app purchases, iCloud) and RevenueCat (subscription management). Your use of those services is governed by their own terms and privacy policies. If optional bank connectivity is offered in a future release, an additional third-party provider's terms would apply and connecting an account would be your choice.
10. Intellectual property
The App, including its software, design, text, graphics, and the Payday Flo and Neon Path Labs names and logos, is owned by Neon Path Labs LLC and protected by intellectual property laws. These Terms grant you no rights in our trademarks. The data you enter remains yours.
11. Feedback
If you send us ideas or suggestions, you grant us a perpetual, worldwide, royalty-free licence to use them without obligation or compensation to you. We welcome the input.
12. Changes to the App
We may add, change, suspend, or discontinue features at any time. We will try to avoid disrupting paid features without notice, and if we permanently discontinue a paid feature during a period you have paid for, we will make a reasonable accommodation.
13. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CALCULATION, PROJECTION, OR REMINDER WILL BE ACCURATE OR DELIVERED ON TIME.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEON PATH LABS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FINANCIAL LOSS — INCLUDING MISSED PAYMENTS, LATE FEES, OVERDRAFT CHARGES, INTEREST, OR PENALTIES — ARISING FROM OR RELATING TO YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) TWENTY-FIVE US DOLLARS ($25).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Neon Path Labs LLC and its members, officers, and agents from any claims, damages, losses, and reasonable legal fees arising from your misuse of the App or your violation of these Terms or of applicable law.
16. Termination
You may stop using the App at any time by deleting it. We may suspend or terminate your access if you materially breach these Terms or use the App unlawfully. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
17. Apple
You acknowledge that these Terms are between you and Neon Path Labs LLC only, and not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims. Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Governing law and disputes
These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict of law rules. You and Neon Path Labs LLC agree to the exclusive jurisdiction of the state and federal courts located in Ohio, except that either party may seek injunctive relief in any competent court. Nothing here deprives you of the protection of mandatory consumer laws in your country of residence.
19. General
If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App.
20. Changes to these terms
We may update these Terms as the App evolves. We will revise the "Last updated" date above and, for material changes, provide more prominent notice. Continuing to use the App after an update means you accept the revised Terms.
